Wolne sądy, wolni ludzie. Projekcja filmu „Sędziowie pod presją” i spotkanie z twórcami

Niezależna grupa mieszkańców Brzegu organizuje i serdecznie zaprasza na wydarzenie z projekcją filmu Kacpra Lisowskiego i Iwony Harris pt. „Sędziowie pod presją”. Początek wydarzenia w poniedziałek 2 października 2023 r. o godz. 18.00 w sali kinowej Brzeskiego Centrum Kultury. Wstęp na wydarzenie jest wolny, a bezpłatne wejściówki będą rozdawane pół godziny przed rozpoczęciem seansu.

Projekcję filmu poprzedzi krótkie wystąpienie sędziego Mariusza Ulmana, który wprowadzi widzów w tematykę filmu, odpowiadając na wcale nie oczywiste pytanie: „Dlaczego uczciwym ludziom też są potrzebne niezawisłe sądy”.

Demokratyczne państwo musi gwarantować obywatelom niezależność sądów, bo sędzia, o którego karierze może decydować polityk, będzie skłonny orzekać zgodnie z interesem władzy, lub interesem wpływowych osób zbliżonych do kręgów władzy, a nie zgodnie z przebiegiem procesu, literą i duchem prawa oraz własnym sumieniem. A kto w takiej sytuacji byłby w stanie osądzić polityka ? Możliwość oddziaływania polityków na sędziów jest bardzo duża i groźna, niezależnie od tego, jaka opcja stoi u władzy, bo rozbudza poczucie bezkarności. Równie duża jest presja społeczna, aby sędziowie wydawali „sprawiedliwe” wyroki. Niestety często to oznacza, że za sprawiedliwe uznawane są wyroki zgodne z indywidualnym przekonaniem każdego oceniającego i to nawet bez głębszej analizy samej sprawy. Czy tak być powinno ?

Bohaterowie omawianego filmu zdecydowanie uważają, że nie i podejmują wszelkie kroki, aby żadnym naciskom nie ulegać.

W wyniku tych działań płacą oni wysoką cenę zarówno w swoim życiu zawodowym, jak i osobistym. Powszechność i dotkliwość stosowanych nacisków wobec sędziów, którzy mimo okoliczności zachowują w swoim działaniu niezależność i wierność przyjętym zasadom, skutkuje również „efektem mrożenia” wobec mniej zdecydowanych. Oznacza to reakcję polegającą na tym, że w pierwszej kolejności taka osoba zastanawia się na ile jej działanie i decyzje mogą jej potencjalnie zaszkodzić, zamiast kierować się obiektywną oceną dowodów i literą prawa.

Świadomy obywatel musi upominać się o swoje prawa i ich respektowanie. Największym zagrożeniem dla praw i wolności obywatelskich jest brak wyobraźni ludzi, jak wielki wpływ na codzienne życie każdego z nas ma niezawisłość sądów. Nasza bierność obywatelska, będąca konsekwencją stopniowego oswajania się z pełzającym procesem coraz silniejszych nacisków na niezależność sądów i ograniczaniem demokracji pokazuje władzy, że może posuwać się coraz dalej. Natomiast niezawisłość sądów i niezależność sędziów jest potrzebna dla każdego z nas, nawet jeśli nigdy nie byliśmy i nie będziemy w sądzie.

Film „Sędziowie pod presją” dotyczy właśnie tych kwestii i jest poświęcony polskim sędziom, którzy w czasach próby odebrania sądom niezależności, pozostając wiernymi swojej przysiędze sędziowskiej, stają w obronie Konstytucji oraz niezawisłości wymiaru sprawiedliwości. Sędziowie Igor Tuleya, Waldemar Żurek, Dorota Zabłudowska, Paweł Juszczyszyn i inni razem z niezależnymi prokuratorami, adwokatami i społeczeństwem obywatelskim bronią naszego prawa do niezależnych sądów. Film ukazuje pełną emocji historię ich ciężkiej i pełnej poświęceń walki, którą będziemy mogli śledzić z bliska. To jeden z najważniejszych polskich dokumentów ostatnich lat opowiadający o walce o wartości oraz o niezwykłej solidarności, którą bohaterom filmu okazują zarówno inni sędziowie, jak i zwykli obywatele.

Po projekcji odbędzie się spotkanie i rozmowa z twórcami filmu: Kacprem Lisowskim i Iwoną Harris oraz jego głównymi bohaterami: Igorem Tuleją i Waldemarem Żurkiem.
